House rules

1. Interpretation

1.1 In these house rules Health and Sports is referred to as the ‘club’ and the user of the club is referred to as the ‘member’

1.2 ‘Membership’ means the contract between Health and Sports and/or Debitsuccess (formerly Adfit) and the member.


2. Right of refusal

2.1 Health and Sports is a private members club. The club reserves the right to refuse an application for membership or entry of a guest for any reason whatsoever without explanation. At the club’s sole discretion the club reserves the right to cancel or suspend the membership of any member or guest whose behaviour, actions of otherwise are deemed to have an adverse or possible adverse effect on the profitability or reputation of the club or the enjoyment of the club by other members’ and staff.

2.2 Members are responsible for the behaviour of their guests. It is the responsibility of the member to ensure that their guests abide by the house rules. Any breach of the house rules by a member’s guest may result in the termination of the member’s membership.

2.3 Guests are required to complete a guest registration form and to pay any applicable fee prior to entering the club.

2.4 In the interests of security and health and safety all members and guests must be easily identifiable. The wearing of any head and face gear, including but not limited to, sunglasses, hats, face masks, head dresses etc is prohibited at the sole discretion of Management.


3. Dress standard

3.1 Members and their guests are required to wear recognized sports clothing and footwear in the gym and group fitness studio. Jeans including cut-off jeans, street wear, and beachwear are forbidden. Footwear such as work boots, jandals or sandals are forbidden.

3.2 Members are required to wear recognised swimwear in the pool

3.3 Swimming caps must be worn in the pool.

3.4 Members are required to wear footwear at all times whist on club premises.

3.5 No sleeveless shirts to be worn in the cafe


4. Membership

4.1 Only fully paid up members’ and guests will be admitted to the club.

4.2 Direct debit payments for membership fees are a legally binding contract between the member and the club and/or Debitsuccess that represent a commitment to pay your membership fees until the end of the minimum contract period.

4.3 Should a membership lapse for any period of time a new joining fee may be charged at current joining fee rates.

4.4 Should membership lapse for any period of time the re-joining member may be charged current rates.

4.5 Members are required to present and use their membership card at reception at every visit to gain access to the club.

4.6 Lump sum memberships are not refundable.

4.7 Membership hold policy: please see the membership team in regards to our membership hold policy.

4.8 The club reserves the right to increase membership rates at any time. The club does not recognise any price promise,
whether written, spoken or inferred to not increase membership rates.

4.9 New members will not be subject to price increases prior to completion of their minimum term.


5. Club opening hours

5.1 The club opening hours are posted on the front door of the club.

5.2 The club reserves the right without prior notice of reason to change the opening and closing times.

5.3 The club reserves the right to close the club and/or any facilities and services offered for any reason whatsoever. In such circumstances any compensation or refund to members will be at the sole discretion of the management. The management reserves the right not to pay any compensation or make any refund.


6. Liability

6.1 Members accept that they enter into any activity at the club entirely at their own risk. The club including but not limited to, staff, shareholders and directors, accepts no responsibility whatsoever for any damage resulting from injury or death incurred or arising from any activity undertaken at the club.

6.2 The club accepts no responsibility whatsoever for any loss or damage to personal property including but not limited to clothing, footwear, accessories, computer and music equipment and automobiles.

7. Children

7.1 Children are not permitted in the club unless accompanied by an adult or attending a supervised activity.

7.2 Parents/guardians are responsible for the behaviour of their children whilst on club premises.

7.3 Unless agreed by management in writing, children under the age of 16 are not permitted to use the gym or attend group fitness classes without the supervision of a parent or guardian.

7.4 Swimming caps must be worn in the pool.

7.5 Only recognised swimming attire can be worn in the pool. Beachwear is not allowed.


8. Childminding

8.1 Childminding hours and rates are available at reception.

8.2 Parents/guardians must remain in the club whilst their child/children are in our childminding care.


9. Gym and Group Fitness classes

9.1 Members and their guests must carry and use a towel at all times to place on the equipment and to wipe down the equipment after use. A towel must also be carried and used for all group fitness classes.

9.2 The Club has the right to refuse admission to Group Fitness Classes after the warm up period and we request that participants complete the entire class, including the warm-down.

9.3 Members must return their weights to the racks provided and strip weight plates off  machines when finished.

9.4 The dropping of weights in any area of the gym will not be tolerated.

9.5 The club reserves the right to change the group fitness timetable, classes and instructors as required.


10. Food and beverage

10.1 Only food and beverage purchased at the club can be consumed on club premises.

10.2  All food and beverage are to be consumed in the reception area or members lounge only


11. Lost property

11.1 Please apply to reception if you have lost any property. The club will periodically, clear lost property. The club accepts no responsibility whatsoever for any loss or damage to personal property as per clause 6.2


12. Smoking

12.1 Smoking is not permitted on club grounds or in the buildings.


13. Centre to be free of potential discords or conflicts

13.1 It is in the interests of all members, employees of the club and the club that the club be free of all potential discord or conflicts between members or between a member and an employee of the club arising from any past or present relationship, transaction or other circumstances between them or in any other howsoever arising. The club at any time determining that any such potential discord or conflict had or could affect the club then the club shall have the right to immediately terminate the membership of the member at its complete discretion. The club shall not be required to give any reason for such termination other than it had been made under the provision of this clause. No refund or fees paid will be made.


14. Change of facilities

14.1  The club reserves the right from the time to time change the facilities or services provided.

14.2  The club reserves the right to carry out maintenance and construction works from time to time.

14.3  The club reserves the right to close the facilities from time to time to carry out maintenance or construction works.

14.4  In the event of any such changes to facilities or services or in the event of temporary closure of the facility for the purposes of maintenance or construction works no compensation or refund to members will be made. The member agrees to waive any rights or claims whatsoever to refund or compensation in relation to the temporary closure of the facility.


15. Membership unaffected by change of location or ownership

15.1  The club reserves the right from time to time to change the location or close any of the clubs in the group. Members of a closing club or re-locating club agree to transfer their membership to the receiving club provided the receiving club is located within 8km of the club being closed.

15.2  The club reserves the right to terminate any membership subject to one month’s written notice. In such an event the club is not required to give any reason for termination. In such an event any prepaid fees will be refunded.

15.3  The club reserves the right to assign membership contracts to a new operator without notice or consent by the member.


16.  Member to observe house rules

16.1  The member shall observe the house rules adopted by the club. A copy of the current house rules can be found on the main notice board. The club may amend the rules from time to time. The posting of the new rules within the club shall be sufficient notice to the member. It is the member’s responsibility to be aware of the current house rules.

16.2   Any breach of the house rules may result in the immediate termination of the member’s membership.

16.3 Termination of membership is at the sole discretion of the club management.

16.4.1 In the event of termination of membership due to breaching house rules no refund in the membership fees already paid will be made.

16.4.2 These house rules void and replace all and any previous house rules.
